La práctica del sharenting: Implicancias en la intimidad e identidad digital de las infancias

Abstract

El fenómeno del sharenting hace referencia a la conducta de los/las progenitores/as de difundir fotos y datos de sus hijos/as en redes sociales. Mediante dichas publicaciones, los/as adultos/as participan en la construcción de la identidad digital de sus hijos/as, muchas veces sin considerar su opinión o consentimiento. La exposición de la información compartida, podría acarrear consecuencias que vulneren los derechos personalísimos de los/as niños/ as. El objetivo de este trabajo consiste en examinar los riesgos de la exhibición de las infancias en la red por parte de sus progenitores, y conocer si el resguardo legal existente en Argentina es suficiente o si comporta un nuevo reto para el derecho nacional. Para ello, se analizó la legislación vigente, y se examinó y sistematizó la doctrina y jurisprudencia nacional. A partir de esto, se elaboró un estado del arte sobre el sharenting y los derechos implicados en el fenómeno. Los resultados indican que, si bien se cuenta con protección de derechos, existen riesgos que no tienen regulación específica.

The phenomenon of sharenting refers to the behavior of parents to disseminate photos and data of their children on social networks. Through these publications, adults participate in the construction of their children's digital identity, often without considering their opinion or consent. The exposure of shared information could lead to consequences that violate the very personal rights of children. The objective of this work is to examine the risks of the exhibition of childhoods on the Internet by their parents, and to know if the existing legal protection in Argentina is sufficient or if it entails a new challenge for national law. For this, the current legislation was analyzed, and the national doctrine and jurisprudence was examined and systematized. From this, a state of the art on sharenting and the rights involved in the phenomenon was elaborated. The results indicate that, although there is protection of rights, there are risks that do not have specific regulation.
